Wills and Probate

Wills

The importance of making a will cannot be overstated. We can make sure that your assets pass to those of your choice be it your loved ones or charitable organisations as you intend. We can explain the more technical aspects of the administration process. Our solicitors will draft a will for you taking into account your wishes, commitments and personal financial circumstances and will offer professional advice on matters such as guardians for infant children, tax planning and trusts etc.

Lasting Powers Of Attorney

We offer practical advice on dealing with your personal affairs including those of your family. If you feel that you or those close to you are unable to handle matters on their own, whether it be their finances or otherwise, we are able to guide you through the process of making Lasting Powers of Attorney for Financial Affairs and Health and Welfare and applications to the Court of Protection. If you have any enquiries on these matters please do not hesitate to contact us.

Probate

Following death, it is usually necessary to obtain a Grant of Probate which then enables the executors of the estate to carry out the wishes of the deceased under the Will.

We offer an approachable and sympathetic hand to take the burden from you of administering an estate. We aim to deal with all probate matters in an efficient manner which may involve:

  • obtaining valuations of the deceased’s home, land, accounts, shares and investments
  • dealing with the matter of inheritance tax and other taxes
  • applying for the grant of probate
  • trusts arising from the estate
  • closing accounts, encashing investments, selling the deceased’s home and distributing the estate
  • any claims against the estate by third parties or challenges to the will

We can also provide expert advice on the complexities of trusts devised in Wills and those that need to be created after a person’s death, if for example a beneficiary of the estate is under 18.

We are able to assist with a full range of matters in this regard including the drafting of trusts and issuing or defending proceedings against an estate.
